1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Alogeriatric ("Company," "we," "our," or "us"), governing your access to and use of the HomeDoc mobile application and this website (collectively, the "Service").

By downloading, installing, registering, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy & Data Policy. If you do not agree to these Terms, you must not use the Service.

2. Service Description

HomeDoc by Alogeriatric is a subscription-based home healthcare platform that connects elderly patients and their caregivers with verified specialist doctors for:

  • Monthly scheduled home visits by a qualified specialist doctor
  • Video consultations as an alternative to in-person visits
  • Digital health record management
  • Access to additional on-demand services (emergency support, medicine delivery, home lab tests, caregiver support, nursing, and medical equipment) at additional charges

The Service is a platform that facilitates healthcare delivery. Alogeriatric is not itself a medical provider; doctors using the platform are independent healthcare professionals responsible for their own clinical decisions.

3. Eligibility

To use the Service, you must:

  • Be at least 18 years of age, or an authorised caregiver/guardian acting on behalf of an elderly patient.
  • Be a resident of India.
  • Have the legal capacity to enter into binding contracts under the Indian Contract Act, 1872.
  • Provide accurate, complete, and up-to-date information during registration.

By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to suspend or terminate accounts that do not meet these requirements.

4. Account Registration

You must create an account to access the Service. You agree to:

  • Provide accurate, complete, and truthful information during registration and keep it updated.
  • Maintain the confidentiality of your login credentials.
  • Not share your account with any other person.
  • Notify us immediately at support@alogeriatric.com if you suspect any unauthorised access to your account.

You are fully responsible for all activity that occurs under your account.

5. Subscription & Payment

5.1 Plans

HomeDoc offers subscription plans of 1-month, 3-month, and 12-month durations. Plan pricing is displayed within the HomeDoc application and is subject to change with advance notice.

5.2 Payment Processing

All payments are processed securely through JusPay, our authorised payment gateway partner. By subscribing, you agree to JusPay's payment terms in addition to these Terms. We do not store your card or bank account details.

5.3 Billing

Subscription fees are charged upfront for the selected plan duration. You will receive a payment confirmation within the app and via email upon successful payment.

5.4 Price Changes

We may change subscription prices at our discretion. Price changes will be communicated in advance. Any change will apply to your next renewal or new subscription, not to your current active subscription period.

6. Cancellation

You may cancel your subscription at any time. Please read our full Cancellation & Refund Policy for complete details. Key points:

  • Cancellation can be initiated via app settings or by emailing support@alogeriatric.com.
  • Service access continues until the end of the current paid period.
  • No refunds are provided under any circumstances. This includes partial-month refunds, dissatisfaction, or inability to use the Service.

7. Service Terms & Limitations

7.1 Doctor Assignment

Upon subscription, a specialist doctor will be assigned based on your health profile. You will be notified of your assigned doctor within 3–5 business days. Alogeriatric reserves the right to reassign doctors at its discretion, particularly in cases of doctor unavailability.

7.2 Scheduling

Home visits are scheduled approximately 3–4 days in advance. You will be contacted to confirm a time slot. You must be present or arrange for an authorised adult to be present for the visit.

7.3 Missed Visits

If a visit cannot proceed due to unavailability on the User's part and insufficient notice is provided, the visit may be counted as completed for that month. We will make reasonable efforts to reschedule; however, this is not guaranteed and no refund will be issued.

7.4 Service Availability

HomeDoc currently operates in select cities in India. Service availability in your area will be indicated during registration. We are continuously expanding our coverage.

7.5 Emergency Services

24/7 emergency home visits are available as a separate on-demand service at charges of ₹3,000–₹4,000 depending on distance. These charges are separate from your subscription fee and are non-refundable once the service is rendered. Emergency services are provided on a best-effort basis and are not guaranteed in all situations or locations.

8. Medical Disclaimer

HomeDoc is not an emergency medical service. In a medical emergency, call 112 (national emergency) or 108 (ambulance service) immediately.

The Service facilitates scheduled, non-emergency doctor consultations and visits. It is not intended to replace emergency medical care, hospitalisation, surgery, or any other acute medical intervention. Please read our full Medical Disclaimer.

All medical decisions and clinical judgements are made solely by the licensed doctor assigned to you. Alogeriatric is a technology platform and does not provide medical advice.

9. User Responsibilities

You agree to:

  • Provide accurate and complete medical and personal information. Inaccurate information may compromise the quality of care and, in serious cases, pose risks to your health.
  • Use the Service only for its intended purpose — obtaining legitimate healthcare for yourself or an elderly family member in your care.
  • Treat all doctors, caregivers, and support staff with respect.
  • Not make false, fraudulent, or abusive claims to Alogeriatric or your assigned doctor.
  • Ensure a safe and accessible environment for the doctor during home visits.
  • Maintain the security of your account credentials.

10. Intellectual Property

All content, software, trademarks, logos, and design elements of the HomeDoc application and this website are the intellectual property of Alogeriatric or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes only.

You may not copy, reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.

11. Third-Party Services

The Service integrates with third-party platforms including JusPay (payments), Supabase (infrastructure), Google (sign-in), and Facebook (sign-in). Your use of these third-party services is subject to their respective terms and privacy policies, which are independent of these Terms. We are not responsible for the content, practices, or policies of third-party services.

12. Prohibited Uses

You must not:

  • Use the Service for any unlawful purpose or in violation of any applicable Indian or international law.
  • Attempt to gain unauthorised access to any part of the Service, other accounts, or our infrastructure.
  • Use the Service to harass, threaten, or harm any individual.
  • Impersonate another person or entity.
  • Submit false or misleading medical information.
  • Attempt to reverse-engineer, decompile, or extract source code from the app.
  • Use the Service in any manner that could interfere with, disrupt, or overload our systems.

Violation of these prohibitions may result in immediate account termination and, where applicable, legal action.

13. Limitation of Liability

To the fullest extent permitted by applicable Indian law, Alogeriatric and its directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
  • Any clinical decisions or medical advice provided by doctors through the platform. All medical liability rests with the individual licensed doctor.
  • Any loss of data, revenue, or goodwill.
  • Any damages resulting from third-party services (payment gateway, cloud infrastructure, social authentication).

Our total aggregate liability to you for any claim arising out of these Terms shall not exceed the amount paid by you for your subscription in the three months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Alogeriatric, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any applicable law; or (d) any inaccurate or false information you have provided.

15. Termination

We reserve the right to suspend or terminate your account, with or without notice, if:

  • You breach any provision of these Terms.
  • We determine, at our sole discretion, that your continued access poses a risk to other users, doctors, or the Service.
  • Required by law or court order.

You may terminate your account at any time by following the account deletion process in the app or contacting us. Termination does not entitle you to a refund of any subscription fees paid.

16. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including but not limited to the Indian Contract Act, 1872, the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [CITY, STATE] — TO BE FILLED BEFORE LAUNCH.

Before initiating legal proceedings, you agree to first attempt to resolve any dispute informally by contacting our Grievance Officer at partha94mondal@gmail.com.

17. Amendments

We may revise these Terms at any time. Material changes will be communicated via in-app notification or email at least 14 days before taking effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service and may request account deletion.
